1. Acceptance of Terms:
By booking a tour with Paducah Pub and Winery Tours (hereinafter referred to as "PPWT," "we," "us," or "our"), you (the "Customer," "Guest," or "you") agree to be bound by these Terms of Service and our Cancellation Policy (outlined below), which are hereby incorporated by reference. Please read these terms carefully before making a booking.
2. Booking and Payment:
Reservations: Tours must be booked in advance through our website, by phone, or through authorized third-party booking agents.
Payment: Full payment or a specified deposit may be required at the time of booking. Accepted payment methods will be specified during the booking process.
Pricing: Tour prices are subject to change without notice. The price confirmed at the time of booking will be honored. Prices typically include transportation, guided tour services, and may include tastings or entry fees as specified in the tour description. Unless otherwise stated, prices do not include gratuities for guides or other staff.
Confirmation: Once your booking is confirmed and payment is processed, you will receive a confirmation email with details of your tour. It is your responsibility to review the confirmation and ensure all details are correct. Contact us immediately if there are any discrepancies.
3. Tour Participation:
Minimum Age: Guests must be of legal drinking age in Kentucky (currently 21 years of age) to participate in tours that include alcohol consumption. Valid government-issued photo identification may be required to verify age.
Intoxication: PPWT reserves the right to refuse participation to any guest who appears to be excessively intoxicated or whose behavior is deemed disruptive or unsafe for themselves or others. No refunds will be issued in such cases.
Conduct: Guests are expected to conduct themselves in a respectful and appropriate manner throughout the tour. We reserve the right to remove any guest from a tour if their behavior is deemed offensive, dangerous, or disruptive to the enjoyment of others.
Dietary Restrictions and Allergies: Please inform us of any dietary restrictions or allergies at the time of booking. While we will do our best to accommodate reasonable requests, we cannot guarantee that all venues will be able to cater to all needs.
Personal Belongings: PPWT is not responsible for any loss or damage to personal belongings brought on the tour. Guests are responsible for their own items.
Itinerary Changes: While we strive to adhere to the advertised itinerary, unforeseen circumstances (such as weather, traffic, venue closures, etc.) may necessitate changes. We reserve the right to modify the itinerary without prior notice.
4. Liability and Assumption of Risk:
By participating in a PPWT tour, you acknowledge that there are inherent risks involved in traveling, visiting pubs and wineries, and consuming alcoholic beverages. You voluntarily assume all such risks.
To the fullest extent permitted by law, PPWT, its employees, agents, and representatives shall not be liable for any injury, loss, damage, accident, delay, or inconvenience that may occur during or in connection with your tour, whether caused by negligence or otherwise.
You agree to indemnify and hold harmless PPWT, its employees, agents, and representatives from and against any and all claims, demands, actions, causes of action, losses, damages, judgments, obligations, costs, and expenses (including attorneys' fees) arising out of or relating to your participation in the tour or your breach of these Terms of Service.
5. Photography and Media:
PPWT reserves the right to take photographs and videos during tours for promotional purposes. By participating in a tour, you consent to the use of your image and likeness in such materials without compensation. If you do not wish to be photographed or recorded, please inform your tour guide.
6. Governing Law:
These Terms of Service shall be governed by and construed in accordance with the laws of the Commonwealth of Kentucky, without regard to its conflict of laws principles. Any legal action arising out of or relating to these terms or your tour shall be brought exclusively in the state or federal courts located in Paducah, Kentucky.
Paducah Pub and Winery Tours - Cancellation Policy
This Cancellation Policy outlines the terms and conditions under which tour bookings can be cancelled or modified.
1. Customer Cancellations:
Individual Bookings (Generally for groups of less than 10):
Cancellations made 7 days or more prior to the scheduled tour date will receive a full refund, less any non-refundable booking fees if applicable.
Cancellations made between 3 and 6 days prior to the scheduled tour date will receive a 50% refund.
Cancellations made less than 3 days (72 hours) prior to the scheduled tour date are non-refundable.
"No-shows" will not be refunded.
Group Bookings (Generally for groups of 10 or more): Specific cancellation terms for group bookings will be outlined in the booking agreement. Please refer to your agreement for details.
2. Cancellations or Modifications by Paducah Pub and Winery Tours:
PPWT reserves the right to cancel or modify a tour due to unforeseen circumstances beyond our control, such as severe weather, safety concerns, venue closures, or insufficient bookings.
In the event that PPWT cancels a tour, you will be offered the option to:
Reschedule your tour for a mutually agreed-upon date and time, subject to availability.
Receive a full refund of the tour price.
PPWT is not responsible for any consequential losses or expenses incurred by the customer due to a tour cancellation or modification by us.
3. How to Cancel:
To cancel a booking, you must notify us in writing (via email is preferred) or by phone during our business hours.
The cancellation will be effective on the date and time we receive your notification.
4. Refunds:
Refunds will be processed using the original payment method within a reasonable timeframe (typically 7-10 business days) after the cancellation is confirmed.
5. Rescheduling:
Requests to reschedule a tour may be accommodated depending on availability. Please contact us as soon as possible if you wish to reschedule.
Rescheduling requests made within 72 hours of the tour may not be possible or may be subject to a rescheduling fee.
6. Exceptions:
Certain tours or special events may have different cancellation policies. Any exceptions will be clearly communicated at the time of booking.
